Regulations of the ChillAndDive.pl online store
§1 General provisions
- The ChillAndDive.pl online store, available at https://chillanddive.pl, is run by DBRIDGE Sp. z o.o. based at ul. Echa forest 21b, 03-257 Warszawa, entered into the National Court Register under KRS number 0000981309, NIP 5242945385, REGON 522538698.
- Contact with the store is possible by phone: +48 880 220 101 and via the e-mail address available on the store’s website.
- The Regulations define the rules for using the Online Store, in particular:
a) placing orders and concluding sales contracts,
b) payment methods,
c) delivery,
d) rules for complaints and returns,
e) processing of personal data. - Using the Store constitutes acceptance of these regulations.
- The sales contract is concluded in accordance with Polish law.
§2 Offer and prices
- The store offers retail sale:
a) diving equipment and accessories,
b) sports and tourist clothing,
c) diving services, including courses, workshops and vouchers for classes. - Prices are given in Polish zlotys (PLN) and include VAT.
- Information about products constitutes an invitation to conclude a contract, and not an offer within the meaning of the Civil Code.
- The store reserves the right to change prices, promotions and assortment, but the changes do not affect orders already placed.
- In the case of services (courses, vouchers), additional detailed regulations may apply – available on the Store’s website.
§3 Placing orders
- Orders can only be placed via the website https://chillanddive.pl
- The customer is obliged to provide true data necessary to complete the order.
- Placing an order constitutes the Customer’s offer.
- The contract is concluded when the Store sends confirmation of order acceptance to the Customer’s e-mail address.
- The store may refuse to process an order in the event of:
a) providing incorrect data,
b) out of stock,
c) suspected abuse. - Creating an account in the Store is voluntary and is not required to place an order.
§4 Payments
- Available payment methods:
- traditional transfer,
- online payment via payment systems (e.g. Przelewy24),
- payment card.
- Payment for the order must be made within 7 business days, otherwise the order may be canceled.
§5 Delivery and acceptance
- Deliveries are made in Poland and European Union countries.
- Delivery costs are calculated when placing an order and may depend on the type of product, weight or country of delivery.
- Standard delivery time is 2-7 business days from receipt of payment, unless the product description indicates otherwise.
- The customer is obliged to check the shipment upon receipt. In the event of mechanical damage, a damage report must be prepared with the courier.
Personal collection is possible only after prior arrangement with the Seller.
§6 Digital products and vouchers
- The store offers electronic vouchers and registration for diving services.
- Detailed rules for redeeming vouchers are specified in separate regulations for diving classes.
6.1 Types of vouchers
- Personalized voucher – assigned to the person indicated during the purchase.
- Amount voucher – has a specific nominal value that can be used as payment for the Store’s services or products.
- Service voucher – refers to a specific service (e.g. a trial diving lesson). The scope of the service is specified in the voucher description.
6.2 Scope of services covered by the voucher
- The detailed scope of the service is available in the offer description on the Store’s website.
- The voucher may include, among others:
a) diving trial lessons,
b) swimming pool activities,
c) PADI courses,
d) first aid training. - The client is obliged to meet the health requirements necessary to provide the service.
6.3 Restrictions and surcharges
- Voucher redemption may be limited by seat availability, pool occupancy or seasonality.
- During the high season, selected services may require an additional fee or may not be available as part of the voucher.
- If the value of the voucher is lower than the price of the service on the day of implementation, the customer pays the difference.
- The voucher does not cover additional costs not mentioned in the service description.
6.4 Expiration date
- The voucher is valid for 12 months from the date of purchase, unless the offer description indicates otherwise.
- After expiry of the validity period, the voucher expires and is not refundable or extended (unless otherwise agreed individually).
6.5 Delivery of the voucher
- The voucher is delivered:
a) electronically (PDF to e-mail) within 15 minutes from the moment the payment is credited to the account.
b) by post/courier – for an additional fee.
c) The voucher is shipped within 7 business days from the moment the payment is credited to the account. - The customer should report errors in the voucher data within 48 hours.
6.6 Principles of implementation
- To arrange the redemption of the voucher, the Customer contacts the Seller.
- Reservation is only possible after confirmation of availability by the Seller.
- The date can be changed no later than 48 hours before the classes.
- Subsequent reference – is treated as use of the service.
- The voucher cannot be exchanged for cash or another service (unless the description states otherwise).
- The unused part of the voucher is non-refundable.
6.7 Cancellation and withdrawal from the contract
- The customer may withdraw from purchasing the voucher within 14 days of purchase, unless it has not been used.
- Once the service has started, withdrawal is not possible.
- Cancellation of the agreed date after exceeding the permissible time results in the voucher being considered as completed.
6.8 Voucher complaints
- Complaints regarding vouchers should be submitted by e-mail to info@chillanddive.com.
- The complaint should include: order number, voucher number, description of the problem and documentation (if applicable).
- Complaints are considered within 14 calendar days.
- Complaints resulting from the failure to use the voucher due to the customer’s fault will not be accepted.
- Complaints are dealt with in accordance with the internal quality procedure DBRIDGE Sp. z o.o.
§7 Complaints and discrepancies
- The Seller applies a complaint handling procedure consistent with the internal quality management system DBRIDGE Sp. z o.o.
- The complaint may concern:
a) non-compliance of the goods with the contract,
b) damage to the shipment,
c) incorrectly performed service. - The complaints procedure includes:
- identifying and documenting non-conformities,
- cause analysis,
- determining further procedure,
- removal of inconsistencies,
- assessment of the effectiveness of actions,
- entry in the Register of Nonconformities/Complaints (Appendix No. 4).
- Complaints are reported directly to Top Management, which coordinates the process and contacts the client.
- After determining the solution, the Store presents the Customer with a written proposal and, after its acceptance, implements corrective actions.
- Corrective actions are documented in the Corrective Action Register (Appendix No. 4a).
- The store is responsible for non-compliance of the goods with the contract in accordance with the Consumer Rights Act.
§8 Returns (withdrawal from the contract)
- A customer who is a consumer has the right to withdraw from a distance contract within 14 days from receipt of the goods.
- To exercise the right of withdrawal, please send the declaration electronically to the email address info@chillanddive.com or by post to the following address: DBRIDE ul. Echa forest 21b, 03-257 Warszawa.
- The product must be returned:
a) intact,
b) complete,
c) preferably in the original packaging. - The customer covers the cost of returning the goods, unless the return is due to the Store’s fault.
- The refund is made no later than within 14 days of receiving the returned product.
- The right of withdrawal is not available in the case of:
a) services performed in full before the withdrawal period with the customer’s consent,
b) personalized products,
c) vouchers or courses that have already been partially or fully redeemed.
§9 Personal data protection (GDPR)
- The personal data controller is DBRIDGE Sp. z o.o.
- The data is processed for the purpose of:
a) order fulfillment,
b) contact with the Customer,
c) keeping settlements and accounting documentation,
d) marketing activities – only with the Customer’s consent. - The customer has the right:
a) data access,
b) rectification thereof,
c) removal,
d) carrying,
e) filing an objection. - Data is transferred only to entities necessary to complete the order (e.g. courier companies, payment operators).
- Detailed rules for data processing are specified in the Privacy Policy available on the Store’s website.
§10 Liability
- The Seller is not responsible for:
a) Customer’s actions inconsistent with the regulations,
b) damages resulting from providing incorrect data,
c) interruptions in the operation of the Store caused by force majeure. - In the case of diving services, the client is obliged to read the safety regulations and meet health conditions.
§11 Final provisions
The store reserves the right to change these regulations.
Changes are effective from the moment of their publication on the website.
In unregulated matters, the provisions of the Civil Code and the Consumer Rights Act apply.
The Regulations enter into force on the day of publication on the Store’s website.
